Florida Senate bill Number 1196, as of July 1, 2010.  This gives the right of Home Owner Associations to demand payment from your tenants for financial obligations to the association.  If the tenant responds in good faith to the association, they will enjoy immunity from any landlord-tenant claim brought by the Owner.  If the tenant fails to meet the demand of the association, the association is with in their rights to stand in the shoes of the landlord/owner and file suit for eviction.

My They don't work tenants


"My "they don't work" tenants just bought a 65inch widescreen HD television and it takes up the entire wall. Since there is a broke down car in the front yard and they have chickens I think the giant TV. has just brought them into the "white trash" circle.  The circle is now complete...

Oh, by the way, they decided to pay me a reduced rent as there electric bill is too high due to their comfort zone of keeping the inside temp around 70 and feel that the insulation and older style windows do not meet the current building codes for adequate energy efficientcy.

Tenants being Served with Foreclosure Papers

Question:

Dear Big Boy, 

Because I had vacancies much of last year on my duplex I fell behind on my mortgage payments and they stared foreclosure proceedings. Prior to and at this time I am involved in an effort to reorganize my mortgage. Because this is currently a lengthy procedure because of the economy, I still haven't got an answer one way or another. However, it does look favorable.

My current tenants received a notice from the law office handling the foreclosure in fact they knew before I did, that it was pending. Even though I have assured them that I do not intend to let the foreclosure happen, they have decided they do not have to pay the rent and that I can not evict them.

I believe I still have the legal right to evict them, but am unsure if a Judge would agree.

Have you run into this and what is your opinion.

I run into this every day.  You are doing the right thing.  In fact I am doing exactly the same thing with several of my properties.  Some banks are unwilling to work with you unless these properties are behind, or Lis Pendens has been filed. 

Directly, if they do not pay they can not stay.  In no way will this become an issue in the eviction process.  Even if the tenant is granted a hearing there excuse will not be heard by the court, and if they deposit the money in  the register, it will be given to you.  Feel free to give me a call.
